4. Disclosure of data to third parties

4.1 Active data transfer

In order to fulfill certain invoicing and accounting tasks as well as payment transactions, we can and must pass on certain data to our accounting department, which may be an external service provider. Apart from that, sensitive data will not be actively passed on to other third parties without your explicit consent. We would like to draw your attention to the fact that data transmission on the internet (e.g. communication by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible.

There may be exceptional cases in which data under special circumstances and within the scope of legal possibilities or obligations, could be disclosed to third parties. Examples are:

Law enforcement
We cannot exclude that there could be situations in which we are obliged by law to pass on data for the purpose of law enforcement to provide information to law enforcement agencies and courts.

Reports in the event of bad debts or misuse
In the event of bad debts or possible legal disputes between us and you, if you are our customer, supplier or other contractual partner, the first priority is always to find an amicable solution. If this fails in individual cases, we reserve the right to report payment defaults or misuse to third parties on the basis of applicable legal principles.

4.2 Passive data sharing

In the modern age of communication and Corona pandemic decentralized work such as remote and home-office, we may also use common messenger services such as SMS, chat APPs (e.g., WeChat, Threema, etc.), or phone, VoIP, or video conferencing services (e.g., Microsoft Teams, Zoom, etc.) from a variety of providers. These and other applications may be installed and running on our hardware devices such as computers and/or smartphones. It is common knowledge that many providers of such services transfer data from the devices to their own servers, sometimes "forcibly." "Forcibly" means that, although certain permissions must be agreed to during installation, the service cannot be used without consent. We, too, will normally give „forcibly consent“ to certain APP permissions, especially in cases where the service cannot be used without such consent, but at the same time is a widely used and common service.
Example: If you have provided us with your phone number and we have stored your phone number in our cell phone as "contacts" and we have a phone call with you, and we are using a chat APP to communicate or it is running in the background, there may be a possibility that the APP provider that has compulsory required "Access to Contacts" and/or "Read Calling History" permissions may transfer your phone number, name and/or other personal data to its own server without noticing us, without us being able to avoid this, or without making us aware of what the specific transferred data exactly is and where it goes.
As another example, it is widely known that Chinese authorities may have full access to all chat content and voice messages sent using Tencent's APP WeChat. However, the WeChat service is very widely used in China, so it is common for communications between you and us (if we communicate via WeChat), or internal company communications between our employees, to include data such as names, photos, phone numbers, location and address information, and other information, as WeChat chat content.

5. Geo-location of data storage

Our website, the cloud server we use and the e-mail service we use all are on servers located in Germany. Currently we do not operate or use our own servers or servers rented by us in other countries. Since our headquarters are in the People's Republic of China, data is also stored on devices such as laptop computers and cell phones within the territory of the People's Republic of China. Such devices are not fixed and could be taken to and used in other countries during business trips.

6. Additional data protection provisions

As our headquarters are in the People's Republic of China, local Chinese data protection laws also apply, in particular with regard to the protection of the personal data of Chinese citizens.

7. Final clause

This privacy policy may be adapted by us over time. This can be done by simply changing this text on our website and does not require any special notification or advance notice, also we may not contact or inform you individually in case of changes. In the case of different languages of this privacy statement, in case of doubt, the German language version shall be valid.
